Please read these Terms and Conditions ("Terms") carefully before placing an order with Black Fire Foods. By placing an order, you agree to be bound by these Terms.

2. Definitions
- "Goods" means the food products listed for sale on our website.
- "Order" means your offer to purchase Goods from us.
- "Contract" means the legally binding agreement between you and us for the supply of Goods.
- "Consumer" has the meaning given in the Consumer Rights Act 2015.
- "Website" means blackfirefood.com.
3. Eligibility to Order
By placing an Order, you confirm that:
- You are at least 18 years old (or 16 where the Goods do not include age-restricted products);
- You are legally capable of entering into a binding contract;
- You are providing accurate and complete information; and
- You are ordering for a permitted delivery address within our delivery area.
If any of our Goods contain alcohol or other age-restricted ingredients, you must be 18 or over to purchase them and proof of age may be required on delivery.
4. Orders and Contract Formation
4.1. The display of Goods on our Website is an invitation to treat, not an offer.
4.2. When you place an Order, you are making an offer to purchase. We will send you an acknowledgement email confirming we have received your Order. This is not acceptance.
4.3. A Contract is formed only when we send you a separate email confirming that your Order has been dispatched. Until that point, we may decline your Order for any reason, including (without limitation) stock unavailability, pricing errors, suspected fraud, or our inability to deliver to your address.
4.4. If we cannot accept your Order, we will notify you and refund any payment in full.
5. Pricing
5.1. All prices are shown in pounds sterling (£) and are inclusive of VAT (where applicable) at the prevailing rate.
5.2. Delivery charges are additional and will be displayed clearly before you confirm your Order.
5.3. We take reasonable care to ensure prices are correct. If we discover a pricing error after you place an Order, we will contact you to confirm whether you wish to proceed at the correct price or cancel. We are not obliged to supply Goods at an incorrect price.
6. Payment
6.1. Payment is taken at the point of Order via the payment methods shown at checkout.
6.2. By submitting payment details, you confirm that the card or account is yours and that there are sufficient funds to cover the transaction.
6.3. Payments are processed securely by Shopify, our ecommerce and payments platform. We do not store full card details.
7. Delivery
7.1. We deliver to addresses within the United Kingdom (including Northern Ireland), Europe, and the United States. We do not currently deliver outside these areas.
7.2. Estimated delivery times are shown at checkout. These are estimates only and are not guaranteed. Time of delivery is not of the essence.
7.3. Risk in the Goods passes to you on delivery. Title passes to you once we have received payment in full.
7.4. If no one is available to receive a delivery of perishable Goods, our courier may leave them in a safe place or attempt redelivery. We are not responsible for spoilage if delivery fails because of inaccurate address details, your absence after agreed delivery arrangements, or your instruction to leave Goods in an unsuitable location.
7.5. Please inspect your delivery on arrival and report any visible damage, missing items, or temperature concerns within 48 hours of delivery (see Refund Policy).
7.6. International deliveries. For deliveries outside the United Kingdom, you are the importer of record. This means:
- You are responsible for any import duties, taxes, customs charges, or other fees imposed by the destination country.
- Delivery times for international orders may be longer than domestic orders and can be affected by customs clearance.
- It is your responsibility to ensure the Goods you order can lawfully be imported into your country. Some countries restrict or prohibit the import of certain foods, ingredients, or packaging types.
- If a parcel is refused, returned, or destroyed by customs because of import restrictions or unpaid duties, we cannot refund the cost of the Goods or delivery.
8. Food Information, Allergens and Suitability
8.1. Allergen information for each product is provided on the product page and on the packaging in accordance with the Food Information Regulations 2014 (as it applies in Northern Ireland under the Windsor Framework) and Regulation (EU) 1169/2011.
8.2. The 14 major allergens are clearly identified where present: cereals containing gluten, crustaceans, eggs, fish, peanuts, soybeans, milk, nuts, celery, mustard, sesame, sulphur dioxide and sulphites, lupin, and molluscs.
8.3. If you have a serious allergy or intolerance, please contact us at tim@blackfirefood.com before ordering so we can confirm whether a product is suitable for you. You are responsible for checking ingredients and allergen information before consuming.
8.4. Always check the "best before" or "use by" date and storage instructions on the packaging.
9. Cancellation and Refunds
9.1. Perishable goods exemption. Under Regulation 28 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, your right to a 14-day "cooling off" cancellation does not apply to:
- Goods which are liable to deteriorate or expire rapidly (most fresh, chilled, or perishable food); and
- Sealed goods which are not suitable for return for health or hygiene reasons once unsealed.
9.2. For non-perishable Goods that are unopened and in their original sealed condition, you have 14 days from receipt to notify us of cancellation and a further 14 days to return them. Return postage is your responsibility unless the Goods are faulty.

9.4. Nothing in these Terms affects your statutory rights as a Consumer under the Consumer Rights Act 2015 in respect of Goods that are faulty, not as described, or unfit for purpose.
10. Faulty, Damaged or Incorrect Goods
10.1. We take great care in packaging and dispatching our Goods. If your Goods arrive damaged, spoiled, are incorrect, or are not as described, please contact us within 48 hours of delivery at tim@blackfirefood.com with your order number and photographs of the issue.
10.2. We will arrange a replacement, refund, or other appropriate remedy in accordance with the Consumer Rights Act 2015.
11. Our Liability
11.1. Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Breach of your statutory rights under the Consumer Rights Act 2015; or
- Any other liability that cannot lawfully be limited or excluded.
11.2. Subject to clause 11.1, our total liability to you for any loss arising under or in connection with the Contract shall not exceed the price paid for the Goods giving rise to the claim.
11.3. We are not liable for any loss or damage that is not reasonably foreseeable at the time the Contract was formed.
12. Intellectual Property
All content on our Website — including text, images, logos, branding, recipes, and product descriptions — is owned by or licensed to Black Fire Foods and is protected by UK and international intellectual property laws. You may not reproduce, copy, or use any content for commercial purposes without our prior written consent.
13. Events Outside Our Control (Force Majeure)
We are not liable for any failure or delay in performing our obligations under the Contract caused by events outside our reasonable control, including but not limited to extreme weather, strikes, pandemics, supplier failure, fire, flood, or government action. We will notify you as soon as reasonably possible and work with you to agree a revised delivery date or, where appropriate, issue a refund.
14. Complaints
If you have a complaint, please contact us first at tim@blackfirefood.com and we will do our best to resolve it.
You also have the right to refer your complaint to:
- Consumerline (the Department for the Economy's consumer advice service for Northern Ireland) – www.consumerline.org or 0300 123 6262.
- Trading Standards Service Northern Ireland via your local council.
- The Food Standards Agency in Northern Ireland for food safety concerns – www.food.gov.uk/about-us/northern-ireland-food-advisory-committee.
You may also use the European Commission's Online Dispute Resolution platform if applicable: ec.europa.eu/odr.
15. Privacy and Data Protection
Your personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.
16. Changes to These Terms
We may update these Terms from time to time. The version in force at the time you place your Order will apply to that Contract. The current version is always available on our Website.
17. Governing Law and Jurisdiction
These Terms and any Contract formed under them are governed by the laws of Northern Ireland. Any dispute will be subject to the exclusive jurisdiction of the courts of Northern Ireland, although you may also bring proceedings in the part of the UK where you live if you are a Consumer.
